The Full Court of the Federal Court upheld Samsung's appeal against the injunction obtained by Apple which restrained the sale of the Galaxy tabs.

The decision is available online now. One minor caveat: the court stayed the judgement until 4:00pm Friday to allow Apple to file its foreshadowed appeal to the High Court.

I should clarify; this is not a decision on whether the device infringes the IP of Apple (or vice-versa), this is an appeal against the injunction. Until the proceedings at-large are determined, Samsung must keep accounts of the device's sales in case it becomes relevant for an award of damages. promoted/edited forum item

Just think that even if they are equal to the Apple product, an injunction stopping sales over the Christmas period would result in a windful for Apple.

That was one of the main arguments advanced by Samsung, and, it seems, accepted by the FCFCA.

All I want for Christmas is the fees in this case.

I've been thinking about buying a new ipad like thing only with android on it. No clue where to start though. Maybe this could be a good sign.

Design blindness sets in: the most successful product is the only possible design. Which, of course, is nonsense - but a very convincing, insistent, tempting sort of nonsense.

From the perspective of pure expediency (convenience regardless of morality), copying makes a hell of a lot of sense. We’ve all been tempted.

SAMSUNG'S bid to have an interim ban in Australia on its Galaxy 10.1 tablet computer lifted has hit a brick wall.
The Korean electronics maker won its appeal in a Sydney court today to have the ban lifted but Apple was swift to act.

After the Federal Court full bench ruled that the marketing and sale of the tablet be allowed, Apple immediately said it wanted the decision reversed in the High Court. Apple sought to table an affidavit by senior counsel Sue Gilchrist detailing her client's concerns.

Apple told the court it would apply for special leave to the High Court to have the decision overturned.

Apple also sought a new deadline of 4pm AEDT on Friday before the ban was lifted.

Justice Lindsay Foster granted a stay in the lifting of the ban on the Tab 10.1 until Friday at 4pm.

I wish you had made a new thread about that article. It was a good read but by posting in this thread it just makes you seem like a hater. Even if this is a stupid idea for Samsung, it's still good for consumers.

They were released for christmas in japan last year. In other words, it's 12month old tech.

Would you buy a brand new 12month old PC part for full price? No. These will most likely be lowered in price compared to what the premium would have been at original release.

In other words, apple won.

the tablet is still relevant. current tablets have similar specs and won't change until Kal-el quad core tablets start coming out after christmas ... and even then, that's just the initial tablets.

but yeah, apple did win in the end. all this lawsuit nonsense was just to delay the release

We have a few of them at work and trying to avoid my apple bias I still think they are fairly average as far as tablets are concerned (+ one of them already shattered). I'd be grabbing either a Kindle Fire (android) or a TouchPad (if you can find one) - much cheaper and a better user experience.
