Before the police showed up? By the time they rolled up it was pretty much too late.
From what I can gather the cops have to phrase it as a request and get a decision is because even though the PCA test is optional, refusal to submit to one in this circumstance is a separate charge.

Pretty much.

The punishment for refusal is often higher than if you took the test. It's more in line with high range drink driving. So people that are just above and try to play the refusal game, are probably doing themselves more harm than good.

4 months community service and disqualified from driving for 3 years.. cause you know disqualifying from driving worked out real well the first time.. taser to the nuts would have been better me thinks.

Techically, he got 3 years suspended licence on top of his orginal disqualification period. He should be banned all together on harsher re-offenders terms.

I like the addition of community service but this goose wont be bothered by it... I still personally think that some community service should be spent in gaol jobs to give the offender a small taste of what may be next...
